Cake decorating is an art. It takes HOURS for people to decorate a cake. I mean, I can't be the only person to sit down for one How To Cake It video only to look up and realise it has been 5 hours, right? Well, that's not what today's episode is about. It is actually about Miley Cyrus and that time she stole a cake design. No really. It got me wondering if, like art of other forms, you can copyright a cake design. Well Theorists, it's about to get LEGAL!

    Such a bizarre part of the claim is that Miley used 'her handwriting' - can you claim copyright to a font that you used, when the font already existed? It's just capital letters printed - how is that part intellectual property?

    9:16 There's a fourth caveat. Level of Uniqueness. A lot of things that people think should/could be copyrighted are not unique enough to be copyrighted, and yeah, the cake in question is not even close. Anyone could emulate this relatively simply. Honestly, as much as copyright gets abused, anything I create goes public domain. Yeah. 'Nuff said.

    Here's something that I don't see discussed, Miley was likely not even aware of the Rae cake. She was just acting as the model/spokeperson. Someone else on the team that was responsible for that ad probably was the idea thief.

    What I love most about this drama is that it clearly shows that it's not about spreading the message, it's not about fighting for a good cause, it's not even for "empowerment". It's all about personal gain, the "feel good" and personal attention.

    This reminds me of a wedding I was at where the photographer wouldn't let anyone else take photos of "her" poses. She was even downright rude to everyone about it.

  • Miley didn't make money out of the cake design so why is she asking for compensation 😩😩
  • By contrast, marks & Spencer is currently suing aldi for copying their 'Colin the caterpillar' by claiming that the cake is protected under copyright as Colin is a recognisable character, they're not trying to claim the type of cake as their own, only the similarity of the toppings etc
