  • Isn't it kinda silly that all these cases end up in the Supreme Court? Why even have lower courts?
  • Interestingly, the guy who probably is going to have a special counsel knocking at his door is the guy who decides that special counsels are illegal.

  • 28 CFR 510 and 28 CFR 600 give the AG authority to appoint Special Counsels.
  • This is 3 and a row. You forgot her bad ruling about the FBI search she said wasn't legal and the 11th Circuit struck that down first, then the special master.

  • Ultimately, this goes back to an unbalanced Supreme Court. I feel like things are futile.
  • The 11th circuit should immediately honor this appeal and do the right thing and remove Cannon from this case. Do all of these people, including Cannon, not understand the laws and the constitution? They say that Smith had to be confirmed by the Senate to make his appointment as special council constitutional. Negative. Garland had to be and was confirmed by the Senate. The laws and constitution allow him to hire any inferior officer to assist him, without Senate approval. if he needed to be confirmed, then throw out every case involving a special council in history. Because Thomas (SCOTUS) planted this seed in her brain to throw it out for the foregoing reasons, he is obviously not qualified to sit on the highest court in the land either.

  • If this does go to the supreme court Justice Thomas, for a variety of reasons should recuse himself!
  • I'm somewhat surprised that Ms. Greenberg did not mention other options considered by colleagues Andrew Weissmann and Mary McCord. Those make the process go much faster, and can avoid SCOTUS. Listen to their most recent podcast near the end.
